2 Luglio 2008 - How much Italy will have to pay for the non-compliance with the Water Framework Directive?
Italy's record in implementing the WFD is amongst the worst of all 27 Member States, as also illustrated in the 2007 Commission Implementation Report on WFD.
Italy has already been found guilty of breaching its obligations under the WFD for not properly transposing the WFD into national legislation. Further, Italy has in February 2008 been found guilty of breaching under the WFD by not properly providing the environmental analysis of pressures and impacts under art. 5 WFD, but such a procedure has nor yet commenced. The Commission bases its application to the Court for such penalty payments on the criteria length of the infringement, severity of the infringement and economic power of the country involved. As an example of a Court Judgement on a penalty payment, two judgement against France have foreseen from one side a penalty of 31.000 EUR per day, and on the other side a penalty payment of 57 million EUR every six months plus a lump sum payment of 20 million EUR. Italy’s penalty payments depend on whether Italy is willing to deliver on its obligations under the WFD or not.
